Does a Religious Nikah Count as a Legal Marriage in British Columbia?
Published September 27, 2026

You have found your imam, your families are planning the day, and you want to know one thing: once the nikah is done, are you legally married in British Columbia? The answer depends on two or three details that are easy to miss, so here they are in plain language.
The short answer
Only if the imam is registered as a religious representative with BC's Vital Statistics Agency and you have a BC marriage licence. With both, your nikah is also your legal marriage. Without them, it is a religious marriage only.
What makes a marriage legal in British Columbia
- A BC marriage licence. Bought from a marriage licence issuer before the ceremony and valid for 3 months.
- A registered religious representative. The imam must be registered with the Vital Statistics Agency, on application by his religious body in BC.
- Two witnesses aged 19 or over. In BC the age of majority is 19, and witnesses must be adults.
- Registration within 48 hours. The imam submits the registration to Vital Statistics right after the ceremony.
None of this changes the nikah itself. A registered imam performs the ceremony exactly as he otherwise would, with the ijab and qabul, the mahr and the dua, and takes care of the civil side at the same time.
Getting a marriage licence in BC
Licences are sold by marriage licence issuers across the province. You can find one near you with the Vital Statistics search tool. The fee is $100, it includes your first marriage certificate, and it is not refundable. There is no waiting period.
The licence is valid for 3 months. If either of you is 16 to 18, written consent from a parent or guardian is needed, since the age of majority in BC is 19.
Is your imam registered in British Columbia?
In BC, an imam cannot register himself. The governing authority in BC of his religious body applies to the Vital Statistics Agency for him to be registered as a religious representative. Many imams are registered; others perform the religious nikah only.
Ask before you book: are you registered to perform marriages in British Columbia? If not, you can pair the religious nikah with a civil ceremony by a marriage commissioner.
After the ceremony
The imam submits the marriage registration to the Vital Statistics Agency within 48 hours. Because the fee includes your first certificate, it follows once the marriage is registered. Extra copies are ordered separately.
What a religious-only nikah does and does not give you
Religiously, a great deal. You are married in your faith, your contract and mahr are binding between you, and your community recognizes the marriage. Some couples choose this on purpose, for example while one partner is still overseas or the paperwork is not ready yet.
Legally, though, an unregistered nikah leaves you unmarried. That usually means no automatic spousal property rights, no automatic inheritance if one of you dies without a will, and trouble with spousal sponsorship and benefits that ask for proof of marriage.
BC is different from most provinces here. Under the Family Law Act, couples who have lived together in a marriage-like relationship for 2 years are treated as spouses for many purposes, including property division. That still does not make you married, and it does not help with things that need a marriage certificate.
What we recommend
Decide early whether you want the legal marriage on the same day. If you do, confirm your imam is registered in British Columbia, sort out the paperwork in good time, and have your two witnesses ready. If you are having a religious-only nikah for now, agree a plan to register the marriage later and write the mahr and any conditions down clearly. Our mahr calculator can help you agree a figure, and our guide on whether a nikah is legally binding in Canada covers the bigger picture.
